英文摘要	陈洪兵，南京师范大学法学院教授，法学博士。; 【中文摘要】关于公共危险犯的未完成形态，理论与实务的认识误区在于，认为形成危险状态后就没有 犯罪中止成立的余地，以及形成危险状态后因意志以外的原因尚未造成严重后果的，成立犯罪未遂进而 从轻、减轻处罚；问题的实质在于，如何认定公共危险犯的预备、未遂、中止与既遂，以及如何选择适用 分则具体条文以及总则关于犯罪预备、未遂、中止的处罚规定。放火造成了具体、紧迫的危险，如打开 液化气阀门、泼洒汽油，应直接适用第114条定罪处刑；行为人主动消除危险的，成立犯罪中止进而免除 处罚。污染环境罪与生产、销售不符合安全标准的食品罪属于准抽象危险犯，只要排放、倾倒了可能严 重污染环境的毒害性物质，就成立污染环境罪的既遂，正准备倾倒即被查获的，成为未遂；生产了用于销 售的不符合安全标准的食品，即成立生产不符合安全标准的食品罪既遂。 【Abstract】 On the issue of unfinished form of public potential damage offense, there are some misunderstandings that once the dangerous state has formed, crime wouldn’t be suspended, and if the serious consequences have not occurred for the causes beyond the actor’s will, the act would constitute attempted crime, with punishment less severely or comparing lightly. The central points at the issue are how to define criminal preparation, criminal attempt, criminal suspension, and criminal accomplishment of public potential damage offense, and how to apply the articles of special provisions of criminal law and general provisions on penalty. The actor who set fire which causes instant and concrete danger, for example, opening the liquefied gas valve, or splashing gasoline, should be punished according to the article 114 of the criminal law, if actor takes initiative to eliminate the risk,the act constitutes criminal suspension with remit punishment. The crime of environment pollution, and crime of producing and selling food that does not conform to the safety standards are both quasi-abstract potential damage offenses, once the actor discharges or dumps toxic substance which may pollute the environment seriously, the act constitutes accomplished crime of environmental pollution, if the actor be captured when preparing to dump,the act constitutes attempted crime. When the actor has produced the food that does not conform to the safety standards being used for selling, the act constitutes the accomplished crime.; 中国法学会2014年度部级法学研究课题“中国式的刑法竞合问题研究”，项目编号CLS（2014）D039。
