英文摘要陈海波,大连海事大学法学硕士,厦门大学国际法博士研究生,厦门大学法学讲师,中国国际法学会会员,中国海商法协会会员。; 【中文摘要】“塔斯曼海”轮系列案是中国第一例依据《1992 CLC》公约对海洋油污损害民事责任做出判决的案件,也是经修订的《海洋环境保护法》开始实施以 来,中国海洋行政主管部门首次对油污损害海洋生态环境进行民事索赔的案件。 法院在船舶扣押与释放、对共同争议合并审理等方面正确地解释了国际公约、国 内立法的有关规定和立法宗旨。该案对于有关实体争议的法律适用有的值得肯 定,有的值得进一步思考。该案也涉及船舶碰撞对方当事人的法律责任等问题, 有待研究与解决。 【Abstract】The series of cases of the Tasman Sea Ship were the first instance in China in which the International Convention on Civil Liability for Oil Pollution Damage of 1992 (hereinafter referred to the “CLC 1992”)was applied in the civil liability case for oil pollution damage,as well as the first case in which the Chinese competent maritime administration claimed civil compensation for the environmental disaster caused by oil pollution since the implementation of the amended Maritime Environment Protection Law. The court correctly interpreted the relevant provisions and the legislative purpose of the applicable international conventions and domestic legislations in terms of arrest of vessels, their release and consolidated action on joint disputes. The application of the law of substantial dispute in the above mentioned case, on one hand deserves recognition, and on the other hand sparks further consideration. These cases also involve the legal liability of the other party in the vessel collision, which is to be studied and resolved.
