| 英文摘要 | 依职权审查是专利无效宣告程序的重要组成部分，合理界定其范围可以帮助优化专利无效宣告程序。我国司法实践已经对现行依职权审查范围的立法提出了挑战，一些学者也意识到了其立法的缺陷，但并未提出具体的完善建议。基于此，本文结合相关立法和实践，提出确定无效宣告程序中依职权审查范围的四个考量因素，并提出具体的完善建议。 本文除引言和结语外，共分为四章： 第一章为我国专利无效宣告程序中依职权审查范围的立法与实践。我国依职权审查范围经历了先宽松、后紧缩、再适度宽松的立法历程。但是现行《专利审查指南》中规定的依职权审查范围对比实践需要仍然过于狭窄，无法满足实践需要。 第二章为专利无效宣告程序中依职权审查及其...; Conducting examinations ex officio is an important part in patent invalidation procedure and defining its scope can help improve the procedure.
