| 英文摘要 | 在规制海洋污染的国际性公约以及国内立法中，绝大部分是关于船舶污染控制的。因此控制海洋污染的重点以及难点之一就是控制船舶污染。按照我国领海及毗邻区法，整个厦金水域应是我国的领海，但现实的情况是两岸事实上的分割导致这一水域的管理格局是以中间线为准，各自为政。随着两岸三通，两岸经贸往来的频繁，这一水域面临的船舶污染压力也会越来越大。因此以厦金水域为切入点研究船舶污染的控制是很有必要的，我们不能期待用单一的模式（或采国际公约，或单独适用我国法律）来管理这一水域，因此，在这一敏感的水域需要两岸的默契和协调，本文的研究目的也是希望能从法律的角度为两岸在处理船舶污染控制方面提出初步建议。 本文的核心内容主...; The majority of the various international conventions, as well as domestic law of marine pollution, mainly concern vessel-source pollution, which is therefore one of the key issue for controlling marine pollution.
