| 英文摘要 | 近年来，城管滥用职权、野蛮执法事件时常见之于媒体报端，不仅社会反响恶劣，也令执法的权威和政府形象遭到破坏。分析其中的缘由，除了受执法理念、执法依据、执法体制等因素的影响之外，城管行政自由裁量权的规控失衡，对其缺乏合理的规控与监督，是造成其滥用的根本所在。但是，从本质上来看，行政自由裁量权是一种选择权，其包含个人主观理性，并且其行政技术性使得立法、司法都存在规控盲区。在我国法制尚不健全的制度环境中，作为健全议行合一的公共权力体系的重要构件，法外规控机制更凸显出重要性。这个课题值得我们付出精力和心血来研究，探索怎样可以使其不仅符合法治要求，更具有管理创新性和科学性。 本文以城管行政自由裁量权为中...; In recent years, events of abuse of power in urban management law enforcement are reported by media from time to time.
