| 英文摘要 | 国内航运业的船舶挂靠经营现象非常普遍，但调整船舶挂靠关系的法律规范非常欠缺。挂靠船经营过程中通常对外订立诸多合同，而船舶挂靠人、被挂靠公司对此类合同衍生的违约责任应如何承担的问题，是最主要、最常见的纠纷争议焦点。本文结合审判实践、航运实践针对该问题进行深入的逻辑分析研究，指出目前有关该问题的流行学说的弊病，提出“合同类型化处置说”。 本文除前言、结论外，共分三章： 第一章为“船舶挂靠行为概述”。第一节介绍理论界、司法界关于船舶挂靠行为的定义，指出不足，并给出了一个较符合航运业实际的定义；第二节将船舶挂靠的法律性质界定为“协作型联营”；第三节分三个层次分析了船舶挂靠经营模式的危害性。 第二...; Currently affiliation of ship in domestic shipping industry is quite common; however, laws and regulations governing affiliation of ship are far from being enough.
