| 英文摘要 | 近年来，随着我国经济实力壮大，对外投资需求旺盛，境外资本也渴望进入中国市场。在政府主导下的金融改革中，人民币资本项目的进一步开放势在必行。但在资本项目开放直至可兑换的过程中，存在着许多风险，稍有不慎将引起全国性的金融危机。2013年设立的上海自贸区肩负着先行试验资本项目可兑换，为其在全国推广提供经验的重任。这就涉及制度构建和执行的问题，包括上海自贸区资本项目可兑换试点的目标合理么？现有制度能实现这一总目标或其他阶段性目标么？如果能，在实现的过程中需要进一步改进相关法律制度么？如果不能，要如何改进才能实现？这都是本文所要研究的相关法律问题。 本文第一章界定了资本项目和资本项目可兑换的概念和内涵...; In recent years, following the growing developments of China’s economics, the demands of overseas investments from inside China are increasingly high, and foreign capital are eager to invest in China.
