| 英文摘要 | 我国社区矫正是一种由基层司法行政机关具体执行的、把罪犯放置在社区中监管、改造和帮扶的非监禁刑执行制度。随着刑罚理念的文明进步，社区矫正得到越来越广泛的适用，其问题也愈发显现：社区矫正比监禁刑宽缓、人道，但也存在缺陷：被告人、罪犯的人身危险性使得社区矫正必然存在风险，如何控制这种风险，把好社区矫正“入口关”，就需要依靠成熟的社区矫正前社会调查评估机制。但至今，社区矫正制度在我国立法上依然是空白，更不必说统一完善的社区矫正前社会调查评估机制。本文首先探讨了社区矫正工作的重要性，而后从基础理论——人身危险性理论和修复性司法理论出发，阐述了社区矫正前社会调查评估机制对社区矫正工作的可行性与必要性，并立...; Community corrections implemented by the grassroots judicial administrative organ is a specific enforcement regime in our country, the defendants and offenders are policed, non-custodial sentenced and helped reform in the community.
