英文摘要	近年来，全球范围内出现的粮食危机与资源型产品价格大幅波动的困境将出口税制度的研究推向了学术前沿，仔细分析WTO体制下的出口税规则，即可发现不同成员对出口税承担着极不对等的义务。随着中国在原材料案与稀土案中的双双败诉，此种不对等被推向极致——中国不仅需要承担严格的出口税义务，而且无法通过援引一般例外对出口税措施进行抗辩。为此，本文试从司法应对与立法改革角度对WTO出口税制度存在的问题提出完善建议，以期真正实现WTO所倡导的“自由贸易原则”。 本文除引言和结语外，共分三章。 第一章将出口税与其他出口限制措施进行对比并结合经济学与社会学理论对出口税的影响进行分析——本文的创新所在，得出的结论是：...; Recently food crisis and high price volatility of many resources commodities have made export taxes become research focus of international law.
