英文摘要	本文通过对信用证司法实践中最新案例的深度剖析，聚焦于中国司法实践中的 信用证欺诈例外的豁免制度，提出了涵盖国际信用证与国内信用证，实体方面与程 序方面并行的制度完善建议。其中较为新颖的观点为信用证欺诈案中“善意”定义 的界定以及力求在法律层面统一国际信用证和国内信用证制度。 第一章为信用证欺诈例外的豁免制度的概述。笔者首先从信用证独立抽象性原 则、信用证欺诈例外原则与信用证欺诈例外的豁免制度三者之间变化发展的关系着 手，厘清了信用证欺诈例外的豁免制度之内涵。继而对完善信用证欺诈例外的豁免 制度之必要性进行了分析，明确了该豁免制度存在的价值。然后再从《美国统一商 法典》中信用证欺...; This paper focuses on the immunization of L/C fraud exception in Chinese judicial practice with the deep analysis on the latest cases in judicial practice of Letter of Credit and puts forward the perfect suggestions on international Letter of Credit and domestic Letter of Credit in the aspect of both substance and procedure.
