| 英文摘要 | 随着工业化社会的到来，家庭模式、社会思潮都发生了巨大的变化，福利国家也在这一时期得到长足发展。受以上因素的影响，十九世纪以来，未成年人的权利逐渐得到社会的认可和保护。二十世纪中后期，监护法深受福利国家之介入主义(Interventionism)的影响，而呈现出“公法化”的趋势，国家通过立法及司法介入监护关系领域，以维护未成年人权益，而未成年人最佳利益原则的确立，则为国家介入监护关系时的最高指导原则及具体审酌标准。该原则也成为国际人权保护领域未成年人人权保护的最高原则，集中表现就是《联合国儿童权利公约》。但是，我国未成年人监护制度相对于国外大陆法系和英美法系国家的监护制度而言，虽然也确立了未成年...; With the development of industrialization, great changes have taken place in the family form and social philosophy.
