英文摘要	行政指导在法律上的可归责性历来倍受争议。争议点在于行政指导是否为具体行政行为和是否具有强制力。目前司法构架内，行政侵权责任要想得到追究，具体行政行为和具有强制力的定位必不可少。尤其强制力的问题，成为行政指导相对人能否得到救济的必备条件，公安行政指导同样面临上述状况。由于公安行政指导指导主体多、指导内容空间大、即时性强、权力“潜规则”运用突出等特点，使公安行政指导实际侵害相对人或第三人权益的现象较为广泛。而相对人和第三人却并未得到相关的任何利益上的补偿。这显然与“有权力就有救济”、“有损害就有赔偿”的原理不符，促使我们对现有的法律救济框架进行反思。本文从分析公安行政指导法律责任的归责根源入手，力...; There are many arguments on the accountability of administrative direction.
