英文摘要	国际法中的“最低待遇标准”一直尘封在1926年混合求偿委员会在“尼尔案”的裁决里面，西方国家将之作为对外国人待遇的绝对待遇标准。文章从“尼尔案”出发，解析“最低待遇标准”产生的背景，“尼尔案”裁决对“最低待遇标准”内涵的确立，以及标准产生之后带来的影响。 外商投资的待遇标准是国际投资法的重要内容，其中“最低待遇标准”的研究价值显然被“公平与公正待遇”的光芒掩盖，而在NAFTA体制下，美、加、墨三个成员国将“公平与公正待遇”视为习惯国际法下的“最低待遇标准”的一部分。学者对这种立法设计进行了诸多评判，因为由“最低待遇标准”引发的NAFTA仲裁反映了公约设立意图与现实提供给投资者实质保护的尖锐矛...; The 1926 decision on the Neer Claim became the landmark case for the minimum standard of treatment .Western countries put it as an objective protection to the aliens abroad.The paper analyse the background of the minimum standard of treatment and influence of the "Neer Case".
