| 英文摘要 | 告知后同意理论发端于西方社会，是医患关系由传统型向现代型演进过程中的产物，其着眼于诊疗活动的交互性，关注医师与患者之间双向互动关系。告知后同意理论所保护的是患者自主决定权，但是最终旨在维护和落实患者最大福利。为保护患者自主决定权，使患者能充分参与决策过程，医师应履行充分告知义务，这属于独立的注意义务，如果未尽到该义务而导致患者损害的，医师应承担过失责任。因此，明确医师是否达到一定告知标准是判断其履行注意义务是否充分的关键要素。但是，综观我国目前理论学界、现行法律法规和司法审判对这一问题的关注：学界对告知义务判断标准的认识不全面、研究不深入，更没有注意到美国学术界最新提出的学说；法律法规存在疏漏...; Informed consent, originated from the West, is a product of physician-patient relationship which has developed from the traditional mode to the modern mode, and the theory emphasizes interaction of diagnosis and treatment, focuses on mutual relationship between physicians and patients.
