| 英文摘要 | 目前，我国食品安全犯罪形势十分严峻，食品安全犯罪刑法规制也日趋严厉，2011年5月施行的刑法修正案（八）和2013年5月施行的最新司法解释加大了对食品安全领域的保护力度，为依法惩治危害食品安全犯罪编织了较为严密的刑事法网。但仍存在刑事罪名不完善、保护范围窄、与《食品安全法》衔接不紧密，缺乏行之有效的资格刑、过失犯罪无法规制等问题。本文从食品安全和刑法规制的基本理论入手，比较了国内外食品安全犯罪刑事立法的现状，基于食品安全保护立法趋势，从刑法体系、罪名完善等方面提出完善措施，旨在通过刑事实体法、刑事程序法、行政等手段编织一张严密的法网，以确保有罪必罚，维护法律的权威和威慑力。; At present, the situation of China’s food security crime is very serious, the regulations of food safety criminal law are becoming increasingly stringent, the Criminal Law Amendment (eight) executed from May 2011 and the latest judicial interpretation on May 2013 increased the field of food safety protection, and weaved a law net for punishing the criminal of food security.
