英文摘要	近年来，在刑事领域内司法精神病学的应用日趋广泛，但由于我国司法精神病鉴定制度起步较晚，与其他发达国家相比还有一定差距。目前，司法精神病鉴定的提起主要集中在侦查阶段，本文主要针对无刑事责任能力人司法精神病鉴定程序、责任认定等问题进行探讨。文章分为四部分，主要从司法精神病鉴定概述、侦查阶段司法精神病鉴定困惑、域外司法精神病鉴定制度、完善我国司法鉴定制度等内容进行分析交流。 第一部分回顾了我国司法精神病鉴定在刑事领域应用方面的历史沿革，对当今立法现状进行评价，介绍司法精神病鉴定特点，分析完善司法精神病鉴定理论依据。 第二部分介绍侦查阶段司法精神病鉴定存在的困境，从启动随意性大、过于依赖鉴定、鉴定...; The application of judicial psychiatry in the criminal field is increasing in recent years.
