| 英文摘要 | 观人类历史，武装冲突时期或多或少、局部或跨界，甚至大规模毁灭性地破坏环境，不鲜其例。而科技的进步给战争手段带来了发展，对自然环境的潜在危害影响却也不容小觑。自然环境的保护攸关当代以及后代人的生存延续、祸福与共，然而环境保护与武装冲突之间的关系又似紧张拉锯，如何兼顾平衡，值得深入探索。 一些武装冲突法公约，如《日内瓦公约第一附加议定书》和ENMOD，直接将防止严重的战时自然环境破坏纳入规制范围；在承认自然环境为“民用物体”属性的前提下，四大重要人道法习惯原则也能为自然环境提供间接的保护。和平时期的国际法同样能够强化交战方在武装冲突时期的义务。 而义务总是与责任相伴行的。当国际法主体违反规则或...; The history of humankind cannot be separated from the history of war, or armed conflict.
