| 英文摘要 | 基于对司法中心主义的反思及司法危机的倒逼,当今西方法治发达国家不断完善多元化纠纷解决机制。其中,行政裁决以其主体专门、裁决专业、程序简化、裁判高效的优势,在纠纷解决方面发挥着重要的补充作用。目前我国行政裁决制度存在适用范围缩减、程序不规范、救济方式尚未系统化等问题。为健全我国行政裁决制度,完善社会矛盾预防化解机制,上述问题亟待解决。美国的委任司法制度、英国的行政裁判所制度、日本的行政争讼制度对我国行政裁决的完善具有借鉴意义。; In the view of the rethink of judicial centrism,and the pressure caused by litigation explosion,western developed countries has been continued to improve the alternative dispute resolution.Administrative adjudication,which is professional,effective and inexpensive,does play an important role in dispute resolution.And it's also conductive in saving judicial resources,and easing social contradictions.Administrative adjudication in China is now facing several critical problems.Issues of scope,procedure,legal subject and remedies are involved.In order to improve the administrative adjudication in China,and to complete the alternative dispute resolution,above issues must be resolved.The administrative adjudication system in US,UK and Japan are significant references. |
