英文摘要	自上世纪90年代以来,由美国国内关于是否接受“乌拉圭回合一揽子协议“所导致的“1994年主权大辩论“为开端,对于“主权“在当代国际经贸政策规范的制定、实施过程中所起作用这一关键问题,美国著名国际经济法学家约翰·杰克逊教授逐渐形成、并撰文发表了系列观点,其思维进路即称为SOVErEIgnTy-MOdErn(“当代主权观“)。杰克逊力图将主权问题异化为权力分配的问题,并倡议以实用主义的导向将此见解吸收到国家的政策决策进程中。对于这种主权观,因其内在的论证逻辑缺陷和法律价值缺失,尤其应予审慎剖析和辩证评价。; Since early 1990 s,a series of policy debates on whether or not to accept the basket of Uruguay Round Agreements arose in the U.S.The renowned international economic law professor John Jackson has also participated in the Great Sovereignty Debate,and has formed a series of viewpoints on the critical function of the concept of sovereignty in the process of making and enforcing international economic and trade rules.He later condensed his thoughts as Sovereignty-Modern,which endeavors to simplify the sovereignty disputes and debates into a matter of allocation of power.He further advocated to pragmatically incorporate such an approach in the decision-making process at the national level.Due to its inherent flaws in the logic of argument and lack of abstract values of law,the notion of Sovereignty-Modern demands a prudential analysis and dissected evaluation.; 国家留学基金
