英文摘要	拘役判决生效前逮捕被告人存在违反刑事诉讼法、不利于保障人权、救济机制缺失等诸多问题,其根源在于片面强调刑事诉讼打击犯罪职能、克减无罪推定原则、被告人权利意识不强、理论关注度低等多个面向。强调尊重人权司法理念、合理解决司法行为习惯与现行法律规定之间的张力以及切实履行检察机关法律监督职能是解决此问题的可行性路径。; The arresting defendant before the criminal detention sentence comes into force has such defects as breaking the criminal procedural law,threatening human rights protection and lacking relief mechanisms.The root of the problem is as follows: much emphasis put on the function of criminal procedure to fight criminals,derogation of the principle of presumption of innocence,the lack of defendants of right consciousness,and little attention to the related theories.In order to solve the problem,we should give enough respect to human rights,keep balance between the judicial behavior habits and laws and regulations in force,strengthen the duty of procuratorate as a law supervisor.
