中文摘要	首先对国际油污赔偿法律体系下环境损害的定义进行分析,明确了国际油污赔偿机制下可予赔偿的"环境损害"的范围;进而,对我国《民法通则》、《海商法》、《环境保护法》、《海洋环境保护法》等相关法律中涉及民事侵权损害赔偿的一般法律规定以及对环境损害赔偿方面的原则性规定进行了分析;最后,结合国际公约、国际惯例、国内立法和司法实践,得出结论:我国船舶溢油事故中海洋环境损害的赔偿范围应限定在"实际已采取或行将采取的合理复原措施的费用".; This paper firstly analyses the definition of environmental damage under the international legal system of compensation for oil pollution and clarifies the scope of "environmental damage" admissible under the international system;then,an analysis is made on the general legal provisions in respect of compensation for infringement and provisions in principle in respect of compensation for environmental damage under the Civil Law,Maritime Law,Environmental Protection Law and Oceanic Environmental Protection Law of the PRC.Finally,in combination with international conventions,international practice,the PRC law and judicial practice,it is concluded that the scope of compensation for oceanic environmental damage in ship’s oil spill in China shall be limited to "costs of reasonable measures of reinstatement actually undertaken and to be undertaken".; 【作者单位】集美大学航海学院；中国船东互保协会；北京海通律师事务所福建厦门361021；北京100028；【作者英文名】DENG Li-juan1,JIN Cong2,TONG Mei3(1.Navigation Institute,Jimei University,Xiamen 361021,China;2.China Shipowners Mutual Assurance Association,Beijing 100028,China;3.Beijing Haitong Lawer’s Office,Beijing 100028,China)
